Abstract

EPA and its State counterparts are rapidly developing Total Maximum Daily Loads (“TMDLs”) to meet court-ordered deadlines in many States and to avoid schedule litigation by citizen groups in other States. While TMDLs have the potential to drive significant further water quality improvements, many dischargers are greatly dissatisfied with the poor level of science and the “ready, fire, aim” approach that characterizes the TMDL process all too often. The objective of this paper is to help dischargers more effectively manage their participation in the TMDL process.
